Chapter 0 General principle

0.1 Main content

JC (CAMBODIA) INTERNATIONAL AIRLINES Co., Ltd. has established the general conditions for international carriage for passengers and baggage to ensure the effective operation of the ground service for passengers and baggage at the terminals on international flights. It is part of the passenger carriage contract of JC (CAMBODIA) INTERNATIONAL AIRLINES Co., Ltd. Mainly composed of the following:

0.2 Basis for establishment

These conditions are established in accordance with the relevant laws and regulations such as the Cambodian Civil Aviation Law, the Qualification Rules for the Operation of Large Aircraft Public Air Transport Carriers, and the Regulations on the Airworthiness Management Regulations for Civil Aircraft Operation.

0.3 Implementation

0.3.1 For staff and ground service agents of ticket sales and ground services of international carriage for passengers and baggage of JC (CAMBODIA) INTERNATIONAL AIRLINES Co., Ltd., this is the purpose and guidelines to be followed for the operation at the terminal. All departments and personnel related to international carriage for passengers and baggage, including branches, subsidiaries, sales offices, offices and ground service agents must implement it.

0.3.2 The implementation of the general conditions will enhance the standardization, sequencing and standardized management of ticket sales, check-in services, baggage carriage etc., of international carriage for passengers and baggage, so as to achieve safety first, normal flight, and quality service.

 

Chapter 1 Definition

1.1 The following terms in the “general conditions for international carriage for passengers and baggage of JC (CAMBODIA) INTERNATIONAL AIRLINES Co., Ltd.” (hereinafter referred to as “conditions”), unless otherwise specified in the specific terms or otherwise expressly stated, have the following meanings:

1.1.1 “JC AIRLINES” is the abbreviation of JC (CAMBODIA) INTERNATIONAL AIRLINES Co., Ltd.

1.1.2 “Conventions” refer to the Convention for the Unification of Certain Rules for Internationa1 Carriage by Air signed at Warsaw on October 12, 1929, Amendment to the Protocol to the Convention for the Unification of Certain Rules for Internationa1 Carriage by Air Signed in Warsaw on October 12, 1955 signed at The Hague on September 28, 1955, and Convention for the Unification of Certain Rules for Internationa1 Carriage by Air signed at Montreal on September 28, 1999, which are applicable to the carriage under the contract.

1.1.3 “JC AIRLINES Regulations” refer to the provisions of JC AIRLINES that, in addition to these conditions, become effective on the date of publication, including valid applicable fares, so as to manage the carriage of passengers and their baggage.

1.1.4 “International transport” refers to air transport in accordance with the air transport contract entered into by the parties, regardless of whether there is any interruption or transshipment in the transport, and the origin of the transport, the agreed stopover point, and the destination point are not in the territory of the Kingdom of Cambodia.

1.1.5 “Carrier” refers to the public air transport enterprise that issues tickets, carries or agrees to carry the passengers and their baggage listed in the ticket.

Issuing carrier: An airline that displays its digital code on the flight coupon or electronic ticket transaction. The issuing carrier shall be the controlling and authorized entity of the electronic ticket transaction.

Sales carrier: An airline whose code is recorded as a transport carrier on the electronic flight coupon or the value-linked ticket.

Actual carrier: An airline that provides actual air transport and its accompanying services. When there is a bilateral agreement, such as a code sharing agreement, the actual carrier may not be the sales carrier.

1.1.6 “JC AIRLINES Sales Agent” or “Authorized Agent” refer to sales agents who has been authorized by JC AIRLINES to represent JC AIRLINES to sell air passenger and freight carriage products and handle related business within the agreed scope of authorization.

1.1.7 “Passenger” refers to any person other than the crew members who has been approved by JC AIRLINES to be carried on or has been carried on the plane.

1.1.8 “Child” refers to a person who is over the age of two but under the age of twelve on the date of commencement of travel.

1.1.9 “Unaccompanied child” refers to a child over the age of five but under the age of twelve on the date of commencement of travel, who is not accompanied by its parent or a passenger over the age of 18 and is travelling alone.

1.1.10 “Infant” refers to a person who is under the age of two on the date of commencement of travel.

1.1.11 “Seat reservation” refers to the reservation of the seat, class of the passenger or the weight and volume of the baggage reserved by the passenger.

1.1.12 “Flight” refers to the flight of the aircraft at the specified route, date and time.

1.1.13 “Travel Itinerary/Data” refers to the certificate issued by JC AIRLINES for passengers travelling with electronic ticket, on which there is an overview and statement of the conditions or which is handed over to the passengers.

1.1.14 “Conjunction ticket” refers to a ticket that is issued with two or more consecutive ticket numbers of the same carrier and constitutes a single carriage contract.

1.1.15 “Regular ticket” refers to a ticket with which flight and flight dates are listed and the seat is reserved.

1.1.16 “Open-date ticket” refers to a ticket with which flight and flight dates are not  listed and the seat is not reserved.

1.1.17 “Flight coupon” refers to the part of the paper ticket marked with “Carriage Effective”. In the electronic ticket, the flight information stored in the airline database in the form of electronic data indicates that the passenger has the right to fly between the locations specified on the coupon.

1.1.18 “Passenger coupon” refers to the part of the paper ticket issued by the carrier or on behalf of the carrier that is marked with “Passenger coupon” and always held by the passenger.

1.1.19 “Air transport electronic ticket itinerary” (hereinafter referred to as “Travel itinerary”) is the payment voucher provided by the public air transport enterprise and the air transport sales agent enterprise to the passenger when the passenger purchases the ticket, which can be used as a passenger reimbursement voucher, but not as a certificate for passing security checks at the airport and boarding. Each electronic ticket is provided with an itinerary, which can be printed at least one month after the flight takes off. Passenger should keep it properly for use in the refund process.

1.1.20 "Day" refers to the calendar day, including seven days a week. When it is used to send a notice, the notice issuance date is not counted; when it is used to determine the validity period of the ticket, the ticket fill issuance e or the flight start date is not counted.

1.1.21 “Tariffs” refer to the fare, fees and related carriage conditions published by the airline. If necessary, approval should be obtained from the relevant departments.

1.1.22 “Normal fare” refers to the highest fare established for a first, business, premium economy, and economy class of valid adult fare within the applicable period, including the child and infant fare applicable to it.

1.1.23 "Special fare" refers to other fares in addition to the normal fare.

1.1.24 “Agreed transition point” refers to the point of stay scheduled to be on the passenger's travel route, as specified in the ticket or carrier's schedule, in addition to the origin and destination.

1.1.25 “Stopover” refers to that when the passenger travels between the departure point and the destination point with the prior consent of the carrier, the passenger intentionally arranges a trip at a certain location.

1.1.26 “Overbooking” refers to that before the check-in, the actual number of seats reserved for a flight is greater than the number of seats available for the flight's execution model.

1.1.27 “Spillage” refers to the spillage of passengers on a flight because of aircraft type changes and flight mergence caused by machinery, aircraft readjustment and other reasons.

1.1.28 “Code-sharing” refers to that the airline normally uses its own code and flight number on a flight actually operated by another airline or allows the use of another airline code on the flight that it actually carries and flight number. In this case, JC AIRLINES will inform the passengers of the actual carrier when the passengers reserve seats.

1.1.29 “Check-in deadline” refers to the latest time for the passenger to complete the check-in procedure specified by the actual carrier.

1.1.30 “Departure time” refers to the time of closing cabin door after the boarding of passengers.

1.1.31 “No-show” refers to the passenger’s failure to board the aircraft because they fail to finish check-in formalities before stipulated check-in deadline or because their travel documents do not meet the requirements.

1.1.32 “Mis-catch” refers to the passenger’s failure to board the aircraft after finishing check-in formalities at the origin airport or transit airport.

1.1.33 “Wrong boarding” refers to the passenger’s boarding a flight different form the one listed in the ticket.

1.1.34 “Baggage” refers to such articles and other personal belongings carried by a passenger that are necessary for his/her wear, use, comfort or convenience in connection with the trip, including both checked and cabin (carry-on) baggage of the passenger.

1.1.35 "Checked Baggage" refers to any baggage of which the carrier takes sole custody and for which the carrier has issued a baggage check.

1.1.36 "Unchecked Baggage" refers to any baggage of the passenger other than checked baggage, which the passenger takes sole custody of and can be free carried on.

1.1.37 “Hand-carry baggage” refers to any baggage weighted or piece counted by the carrier, of which the passenger takes sole custody during the travel including the stopover period, with the consent of the carrier.

1.1.38 “Free carry-on articles” refer to small articles carried by the passengers during the travel including the stopover period, within the range and number defined by the carrier and with the consent of the carrier.

1.1.39 "Baggage Check" refers to the part of the ticket relating to the carriage of the checked baggage of the passenger.

1.1.40 "Baggage Tag" refers to a document issued by the carrier solely for identification of checked baggage.  

1.1.41 "Damage" refers to  the damage that occurs when the carrier provides carriage or services related to carriage, including death, injury, delay, loss, partial loss or other damage.

1.1.42 “Force Majeure” refers to abnormal, unforeseen circumstance, and in the case of uncontrollable circumstances, even if all possible measures are taken, the consequences cannot be avoided.

1.1.43 “Fare change” refers to the fee charged by JC AIRLINES for the passenger to voluntarily request to change the original flight plan, including changes to flight, date, class, validity period, etc.

1.1.44 “Endorsement” refers to a change to the sales carrier.

 

Chapter 2 Scope of Application

2.1 General provisions

2.1.1 Except as otherwise provided in 2.2, 2.4 and 2.5, these Conditions apply to JC AIRLINES's paid international carriage for passengers and baggage by aircraft. The air routes of Hong Kong, Macao and Taiwan regions shall be implemented in accordance with these general conditions for carriage.

2.1.2 Code sharing: These conditions apply only to codeshare flights actually carried by JC AIRLINES, in accordance with code-sharing arrangements between JC AIRLINES and other carriers.

2.1.3 If non-JC AIRLINES is the actual carrier of the codeshare flight, JC AIRLINES is obliged to inform the passenger of the actual carrier of the flight and is obliged to provide assistance to the passenger when necessary to contact the actual carrier. The passenger's rights and interests refer to the relevant terms of the actual carrier.

2.2  Charter

The carriage provided under the Charter Agreement. These conditions apply only to the circumstances in which the conditions are quoted in the Charter Agreement or charter ticket terms.

2.3 Code sharing

On some flights, JC AIRLINES has shared code with other carriers, which means that even if the passengers have booked JC's flight and hold a ticket with our name or airline code, they may be flying on another carrier. In this case, JC AIRLINES will inform passengers of the actual carrier of the flight when they are seated, purchased, checked in and boarded.

2.4 Priority application of the law

These conditions apply to international carriage provided by JC AIRLINES. If these conditions are inconsistent with JC AIRLINES's tariff rules or applicable laws, the terms are invalid, but the other terms of these conditions are still valid.

2.5 These conditions apply preferentially to other regulations

Except as otherwise provided in these conditions, if any other provisions of JC AIRLINES are inconsistent with these conditions, these conditions shall prevail.

 

Chapter 3 Tickets

3.1 General provisions

3.1.1 The JC AIRLINES ticket is the prima facie evidence of the contract of carriage between JC AIRLINES and the passenger listed on the ticket. JC AIRLINES only provides carriage to passengers who hold JC AIRLINES ticket or airline ticket with an intermodal agreement with JC AIRLINES. The contractual conditions in the JC AIRLINES ticket are an overview of some of the terms of the JC AIRLINES Transport Conditions.

3.1.2 Tickets are not transferable. If the ticket is not presented by the person entitled to take the flight or refund, but JC AIRLINES provides carriage or refund to the person who presents the ticket according to regulations. JC AIRLINES shall not be liable for the person who has the right to take the flight or refund the original ticket.

3.1.3 Some tickets sold at discounted fares may be refunded or not refunded. Passengers should choose the fare that best suits their needs.

3.1.4 Ticket usage requirements

3.1.4.1 For paper tickets, passengers are not entitled to board the aircraft if they fail to present a valid ticket issued according to JC AIRLINES regulations which include the flight coupon on the flight and all other unused flight coupons and passenger coupons. Passengers are not entitled to board the aircraft if they present a damaged ticket or a ticket changed by a non-carrier or its authorized agent.

3.1.4.2 The name of the passenger on the ticket shall be in accordance with the identity information provided by the passenger, otherwise JC AIRLINES shall have the right to refuse to board the aircraft.

3.1.4.3 For electronic tickets, JC AIRLINES has the right to refuse carriage if the electronic ticket of the flight requested by the passenger is not in the unused valid ticket status.

3.1.4.4 Tickets must be used in order from the origin according to the voyage specified in the ticket. Otherwise, JC AIRLINES has the right not to accept it.

3.1.4.5 For each paper flight coupon or electronic ticket, carriage should be provided by JC AIRLINES in accordance with the seat class specified and the flight with seat reserved and date. For paper flight coupon or electronic ticket without seat reserved, JC AIRLINES or its authorized sales agent shall, based on the passenger's application, make a reservation for the passenger based on the applicable fare and the availability of the requested seat.

3.2 Validity period of the ticket

3.2.1 General provisions

3.2.1.1 For the validity period of the ticket, the carriage shall be valid within one year from the date of commencement of travel; if the ticket for the first flight segment is not used or it is not a regular ticket, the carriage shall be valid within one year from the date of ticket issuance.

3.2.1.2 The validity period of the ticket shall be calculated from 0:00 on the next day of the date of commencement of travel or the date of ticket issuance to 0:00 on the next day of the expiration date.

3.2.1.3 The passenger shall complete all the flight segments listed on the ticket within the validity period of the ticket. If the purchased special ticket has special provisions for the travel date, all flights specified in the ticket must be completed within the time limit for the applicable tariff.

3.2.1.4 Multi-segment ticket is calculated from the date of the first segment.

3.3 Extension of the validity period of the ticket

3.3.1 General provisions

3.3.1.1 If, due to one of the following reasons, JC AIRLINES causes the passenger to fail to travel within the validity period of the ticket, the validity period of the ticket may be extended until JC AIRLINESis able to provide the earliest flight with seats in accordance with the class of the fare paid for the ticket:

1) JC AIRLINES cancels the flight for which the passenger has reserved seat;

2) JC AIRLINES fails to stop at transition point of the flight, and the transition point is the origin, destination or halfway stopover point of the passenger;

3) JC AIRLINES fails to reasonably fly the flight according to the schedule;

4) JC AIRLINES causes the missing flight connection of the passenger who has already reserved seat;

5) JC AIRLINES has changed the class of passengers;

6) JC AIRLINES fails to provide a seat that has been reserved in advance.

3.3.1.2 When the passenger starts to travel, if the travel is blocked due to illness during the validity period of the ticket, he/she shall submit and present the doctor's diagnosis certificate issued by JC AIRLINES approved medical institution at the latest before the scheduled departure time of the flight. JC AIRLINES may decide whether to extend the validity period of the passenger and its accompanying personnel in accordance with the fare paid by the passenger.

3.3.1.3 If the passenger dies during the travel, the ticket of the accompanying personnel of the passenger may be changed by the principle of extending the validity period. The change of the ticket shall be handled after the death certificate is provided, and the extension of the validity period of the ticket shall not exceed 45 days from the date of death.

3.4 Loss of paper tickets

3.4.1 General provisions

If the passenger loses the unused paper tickets or flight coupons, travel licenses or service exchange coupons and other carriage vouchers, he/she shall be responsible for it; if it affects the itinerary, JC AIRLINES shall not be liable. JC AIRLINES may, in accordance with the circumstances, comply with the provisions of this section and the conditions of use of fares. Passengers are not entitled to require JC AIRLINES to refund or replace the ticket.

3.4.2  Report of loss of ticket

3.4.2.1  In case of loss or mutilation of a ticket, or part thereof, or non-presentation of a ticket containing the passenger coupon and all unused flight coupons, the passenger must report in written form to JC AIRLINES or its authorized agents and complete the form of '"Application of Lost Ticket". Formalities of reporting the loss of group tickets must be done before the deadline time of check-in. Report of loss cannot be done on tickets of charter flights.

3.4.2.2   When reporting for loss of a ticket, the passenger must present his/her valid identity document, advise the date and place of issuance and the agent coupon or its copy of the original ticket, and present other data or proof satisfactory to JC AIRLINES. If the reporter is not the passenger, valid identity documents of the reporter and the passenger must be presented.

3.4.2.3   If all or part of the lost ticket has been fraudulently used, refunded or claimed, JC AIRLINES is not liable.

3.4.3  Re-issuance of Lost Ticket

3.4.3.1   On principle, a regular ticket, once lost, cannot be allowed to be reissued. But on special occasions, after it's approved by JC AIRLINES's direct sales department which deals with the loss report, and if the passenger provides materials and proofs in accordance with Article 3.4.2.2 of the conditions before the original flight check-in deadline, after confirmed by JC AIRLINES, it is allowed to reissue a ticket on original flights if the following requirements are met:

1)  Passenger fills Application of Loss Report for tickets of JC (CAMBODIA) INTERNATIONAL AIRLINES Co., Ltd.

2)  Passenger declares to agree to compensate for any damage caused thereby to JC AIRLINES, including the damage has been or will be caused by others' using or refunding the lost ticket and the necessary lawsuit fees.

3.4.3.2   An open-date ticket or MCO, once lost, can only applied for refund and cannot be applied for re-issuance.

3.4.3.3   JC AIRLINES has the right to refuse to reissue lost tickets which have not been confirmed. In that case if passenger requests to continue to travel, passenger shall purchase a new ticket at fares applicable then.

3.4.4  Deadline for refunding tickets

The deadline for refunding tickets purely operated by JC AIRLINES is 60 days after 13 months from the date of commencement of travel, or the date of issuance if no portion has been used; if any sector is operated by another carrier than JC AIRLINES, the deadline for refunding is 60 days after 18 months from the date of commencement of travel; Within this period, if someone other than the person entitled to be carried or to be refunded has traveled with or refunded the ticket, JC AIRLINES shall not be liable to refund to the person so entitled.

3.5 Loss of itinerary

If printed itinerary of electronic ticket is lost because of reasons of passengers, according to Regulations on Itineraries of E-ticketsof Air Carriage, it cannot be re-printed.

3.6 Sequence and Usage of Coupons

3.6.1  Ticket purchased by passenger is only applicable for the carriage from the origin to destination via the any agreed transition point as listed on the ticket. The fare paid by passenger is based on JC AIRLINES’s tariff rules and the carriage listed on the ticket. Fare is the basic content of the carriage contract between JC AIRLINES and passenger.

3.6.2 Flight coupons of ticket must be used in the sequence listed on the ticket. Flight coupons that have been used not in sequence shall be refunded according to the refund policy of the unused flight coupon corresponding to the reserved seat within the period of validity.

3.6.3  If passenger wishes to change any aspect of carriage, he/she must contact JC AIRLINES in advance. The fare for passenger’s new carriage will be re-calculated and passenger will be given the option of accepting the new price or maintaining his original carriage as ticketed. If passenger is required to change any aspect of carriage due to Force Majeure, passenger must contact JC AIRLINES as soon as practicable and JC AIRLINES will use reasonable efforts to transport passenger to the next stopover or final destination with no need to recalculate the fare.

3.6.4  If passenger changes his carriage without JC AIRLINES's agreement, JC AIRLINES will assess the correct price for passenger's actual travel. Passenger will have to pay any difference between the price paid and the total price applicable for the revised carriage.

3.6.5 Some changes on the content of carriage such as changing the place of departure or reversing the direction of travel, can result in an increase of price. Many fares are valid only on the dates and for the flights shown on the ticket and may not be changed at all, or only upon payment of an additional fee.

3.6.6 Each flight coupon on the ticket shall specify the class, the date, the flight, and may be used for carriage after the seat is reserved. When it is an open-date ticket, the passengers can apply for seat reservation according to JC AIRLINES's tariff rules and the availability of seats on the flight requested.

3.6.7 If passenger does not show up for any flight, for which he/she is holding a reservation, without advising JC AIRLINES in advance, JC AIRLINES may cancel passenger’s return or onward reservations as shown in the ticket

3.7 On the ticket, the name of JC AIRLINE is abbreviated as the code "QD" of JC (CAMBODIA) INTERNATIONAL AIRLINES Co., Ltd.

3.8 Over-booking

According to the common practice of international civil aviation industry, JC AIRLINES may make suitable over-booking on some flights. Under particular circumstances, it may result in some passengers’ failure to travel on flights as arranged. When there is not enough space, JC AIRLINES will seek for passengers voluntary to disembark and will help them check in on priority. For passengers who cannot travel due to over-booking, JC AIRLINES will do its best to arrange them on the soonest available flight, and will give a certain amount of compensation according to JC AIRLINES Compensation Standard.

 

Chapter 4 Fares and fees

4.1 Application of Fares

4.1.1  Fares apply only for carriage from the airport at the point of origin to the airport at the point of destination. Fares do not include fees for ground transport service and additional services between airports and airports in the same city or between airports and urban areas.

4.1.2  The applicable fare is the fare for the flights in effect on the date of commencement of the carriage covered by the first coupon of the ticket. Once the ticket is issued, the payment remains even with adjusted fare.

4.1.3 A special fare ticket is subject to the conditions of usage specified thereof.

4.2 Routing

Fares apply only to routings published in connection therewith. If there is more than one routing at the same fare, the passenger may specify the routing prior to issue of the ticket. If no routing is specified, JC AIRLINES or its authorized agent may determine the routing.

4.3 Fares for revolutionary disabled soldier, police, child and infant

1) The revolutionary disabled soldiers and police, with the "Cambodian Kingdom Revolutionary Disabled Military Card" issued by the Ministry of Civil Affairs and the "Cambodian Kingdom People's Police Disability Pension Card", purchase tickets at 50% of the normal fare applicable to adult.

2) Child purchases child tickets at normal adult fare with seat provided.

3) Infant purchases infant ticket at 10% of the normal fare applicable to adult without seat provided; if a separate seat is needed, a child ticket should be  purchased. When each adult passenger carries more than one infant, the child tickets should be purchased in accordance with the exceeded number of infants.

4.4 Taxes and Fees

Any tax, fee or charge imposed by government or other authority, or by the operator of an airport, in respect of a passenger or the use by a passenger of any services or facilities will be in addition to the published fares and charges and shall be paid by the passenger and collected by airlines.

On purchasing a ticket, passenger will be advised of taxes, fees and charges not included in the fare, most of which will normally be shown separately on the ticket. The taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of ticket issuance. If there is an increase in the applicable tax or a new tax, fee or charge is imposed after ticket issuance, passenger will be obliged to pay it. Likewise, in the event any taxes, fees or charges which passenger has paid at the time of ticket issuance are eliminated or reduced, passenger may be entitled to a refund of any such taxes, fees or charges as have been eliminated or reduced.

4.5  Fuel surcharge and air insurance surcharge are published and charged by the carrier according to relevant regulations of the State. Infants are exempt from fuel surcharge; children are charged the same amount of fuel surcharge as adults.

4.6 Payment

Fares and charges are payable in any currency acceptable to JC AIRLINES. Unless otherwise agreed by JC AIRLINES and passenger, fares and charges are all paid in

 

Chapter 5 Reservation

5.1 Reservation Requirements

5.1.1  Reservations are not confirmed until recorded as accepted by JC AIRLINES or its authorized agents. Reservations shall be tentative unless and until the passenger makes payment by the time fixed by JC AIRLINES according to the formalities specified by JC AIRLINES, and JC AIRLINES or its authorized agents have issued a validated ticket for the carriage for such space is reserved and issued the related flight coupon to the passenger.

5.1.2 According to JC AIRLINES's regulations, certain special fares may have conditions that will limit or exclude the passenger's right to change or cancel reservations.

5.1.3 JC AIRLINES keeps the right to suspend reservations for a certain flight when it is necessary.

5.1.4 Infants and children must be booked in the same compartment as that of the accompanying person.

5.1.5  Application for change or cancellation of reservation must be raised within the valid period stipulated by JC AIRLINES. When fares have correspondent restrictions, passenger’s change or cancellation of reservation shall be subject to such restrictions.

5.1.6 If passenger does not use his/her reserved seat in accordance with JC AIRLINES regulations and without advising JC AIRLINES in advance, JC AIRLINES may cancel the passenger’s all reservations.

5.2 Special Passengers

A special passenger is someone, during the flight, to be accorded courteous reception; or needing special care on account of his or her physical or mental conditions; or acceptable for carriage in certain conditions. The reservation may be accepted after JC AIRLINES and other carriers concerned consent to the carriage of such special passengers.

5.3  Ticketing Time Limits

If a passenger has not paid for the ticket prior to the specified ticketing time limit, JC AIRLINES may cancel the reservation.

5.4 Personal Data

5.4.1  The personal data provided by passenger to JC AIRLINES is intended for reservation and arrangement of related carriage service. Therefore, passenger authorizes JC AIRLINES to retain his/her personal data and transmit the data to related JC AIRLINES departments, other carriers concerned, or service provider concerned, or organizations authorized by laws and regulations.

5.4.2 Passenger shall be liable for the authenticity of such data, and JC AIRLINES will not be responsible for verification.

5.4.3 If passenger refuses to provide such data, JC AIRLINES may refuse for reservation.

5.5 Seat arrangement

5.5.1 JC AIRLINES will endeavor to honor the passenger's advance seating requests. However, JC AIRLINES cannot guarantee any particular seat , and only is responsible to provide passenger seat according to his/her reserved class. For operational, safety or security reasons, the carrier reserves the right to assign or reassign seats at any time, even after boarding of the aircraft.

5.5.2 (3)Seats near the aircraft’s emergency exits shall be specifically arranged by JC AIRLINES.

 

Chapter 6 Ticketing

6.1  General provisions

6.1.1  Passenger can purchase tickets at the sales office of JC AIRLINES or JC AIRLINES's authorized agencies, or at JC AIRLINES’s website (http://www.jcairlines.com). Passenger can inquire or purchase ticket at JC AIRLINES’s hotline:

6.1.2 Passenger shall present or provide his/her (passenger's) valid identification and contact information when purchasing tickets, and fill up the Reservation Form for Passengers.

6.1.3 JC AIRLINES has the right to request passenger present his/her valid passport or other traveling documents, but will not bear responsibility for the authenticity and the validity of such documents.

6.1.4 When purchasing a ticket for child or infant, a valid birth certificate must be presented.

6.1.5  When purchasing a ticket for a passenger seriously sick or over 32 weeks pregnant, passenger shall provide a valid medical certificate issued by a county level medical department or equivalent medical department level for such carriage that is accepted by JC AIRLINES.

6.1.6 Each passenger shall respectively hold his/her own ticket.

6.1.7 Passengers less than 5 years old must be accompanied by a passenger over 18 years old and with full capacity for civil conduct.

6.2 JC AIRLINES or JC AIRLINES's authorized agencies shall sell one-way, consecutive, or round-trip tickets according to the request of passengers.

6.3 When the flight purchased by the passenger is a codeshare flight, JC AIRLINES is obliged to inform the passenger that the flight is a codeshare flight and its actual carrier.

 

Chapter 7 Check-in and Boarding

7.1 General provisions

7.1.1  The passenger shall arrive at the designated check-in location within the time limit set by JC AIRLINES to complete any Government formalities and departure procedures.

7.1.2  If the passenger fails to arrive in time at the designated check-in location or boarding gate or appears improperly documented or fails to provide an acceptable ticket and not ready to travel, JC AIRLINES may cancel the seat reserved for the passenger to not delay the flight. JC AIRLINES is not liable to the passenger for loss or expense due to the passenger’s failure. If the passenger wishes a refund, the amount of such refund shall be processed in accordance with the voluntary refund regulations.

7.1.3 Check-in deadlines are different at every airport; JC AIRLINES or JC AIRLINES's authorized agencies shall inform the passenger of the check-in deadlines. Passengers shall reserve enough time for check-in formalities. If passenger fails to check in before check-in deadline, JC AIRLINES has the right to cancel passenger's reservation.

7.1.4 JC AIRLINES and JC AIRLINES's ground handling agencies shall open check-in counters in time, accept valid tickets produced by passengers, and process check-in formalities quickly and correctly.

7.1.5 Before boarding, passengers and their baggage and hand-carry items must go through security check.

7.2 Mis-catch

7.2.1 If mis-catch happens due to reasons of passengers, ticket shall be dealt according the rules of voluntary refund.

7.2.2 If mis-catch happens due to reasons of JC AIRLINES, JC AIRLINES shall arrange passenger to travel on the soonest flight; if passenger requests for refund, it shall be dealt according to rules of involuntary refund.

7.3 Wrong boarding

7.3.1 If passenger boards a wrong flight and requests to stop traveling at the destination of the flight boarded, no extra fee shall be charged, and no fee shall be refunded.

 

7.3.2 If wrong boarding happens due to reasons of JC AIRLINES, JC AIRLINES shall arrange passenger to travel on the soonest flight to the destination listed on passenger’s ticket; no extra fee shall be charged, and no fee shall be refunded. If passenger requests for refund, it shall be dealt according to rules of involuntary refund.

7.4 Codeshare flight

7.4.1 On terminal flight dynamic display card (screen), check-in counter, boarding gate, baggage claim hall should display the flight number of both code sharing parties, the actual carrier's flight number in front (or above), sales carrier's flight number behind (or below).

7.4.2 Boarding broadcasts and on-board broadcasts shall broadcast the flight numbers of both parties sharing the code, with the actual carrier's flight number in front and the sales carrier's flight number behind.

7.4.3 Boarding registration

1) Inform passengers to check-in at the designated location according to the procedures prescribed by the actual carrier and the check-in time.

2) The passenger's boarding pass of actual carrier shall have only the flight number of the actual carrier. The boarding pass of the sales carrier shall have both the actual carrier's flight number and the sales carrier's flight number; all passenger's baggage tag only shows the flight number of the actual carrier.

3) Passengers should be received in the following order:

A Passengers with OK ticket recorded in the reservation system;

B Passengers with OK ticket without recorded in the reservation system;

C Alternate passengers

7.4.4 Other

The actual carrier shall be responsible for the inspection of the travel documents held by the passengers; all costs and penalties arising from the refusal of entry or transit due to travel documents held by passengers not meeting the requirements shall be borne by the actual carrier.

 

Chapter 8 Baggage carriage

8.1 General provisions

Baggage carried by JC AIRLINES, is divided into checked baggage and un-checked baggage (hand-carry baggage and free carry-on articles) according to the carriage responsibility.

8.1.1 Items Unacceptable as Baggage

Passenger shall not include in his or her baggage or carry on to the cabin:

8.1.1.1Items that do not constitute baggage as defined in 1.1.34 of the Conditions.

8.1.1.2  Other than those permitted by Dangerous Goods Transportation Regulations of China Civil Aviation and JC AIRLINES regulations, dangerous goods including the following items are not permitted to be carried in checked or un-checked baggage:

1)Explosives;

2)Gas, including flammable gas, inflammable and nontoxic gas, and toxic gas;

3)Flammable liquid;

4)Flammable solid, spontaneous combustible substance; substance that would release flammable gas in contact with water;

5)Oxidizer and organic peroxide;

6)Toxic substance and infectious substance;

7)Radioactive substance;

8)Corrosive substance;

9)Miscellaneous dangerous goods such as magnetic substance.

8.1.1.3 Items, the carriage of which is prohibited by the applicable laws, regulations or orders of any country to be flown from, to or over.

8.1.1.4 Articles those in the opinion of JC AIRLINES are unsuitable for carriage by reason of their weight, shape, size or character.

8.1.1.5 Live animals, except as pets and guide dogs provided for in 8.7.

8.1.1.6 Firearms and ammunition other than for hunting and sporting purposes are prohibited from carriage as baggage.

8.1.2 Items unacceptable as checked baggage

Passenger shall not include the following items in checked baggage. If such items included in checked baggage is lost or damaged, JC AIRLINES is liable for it only as common checked baggage:

  1. Fragile items;

  2. Perishable items;

  3. Money or valuable securities;

  4. Jewelry;

  5. Precious metal and articles thereof;

  6. Antiques and valuable paintings;

  7. Computer and personal digital device;

  8. Samples and valuables;

  9. Lithium battery;

  10. Important files and documents;

  11. Traveling documents, medical certificates, X-ray films;

  12. Prescribed drug that needs to be taken regularly.

8.1.3  Limitation on carriage

JC AIRLINES has strict quantity limits and packaging requirements for the carriage of the following items. They may be accepted only in accordance with the JC AIRLINES regulations as checked baggage.

8.1.3.1 Precision instrument and electric appliances shall be carried as cargo. They may be accepted only in proper packaging as checked baggage. Free baggage allowance does not apply to such items.

8.1.3.2 Sporting equipment, including firearms and ammunition for sporting purposes.

8.1.3.3  Dry ice, alcoholic beverages, smoking utensils, medicines or cosmetics required for travel.

8.1.3.4   Diplomatic envelopes, confidential files.

8.1.3.5 Edge tool and blunt other than controlled knives, such as kitchen knife, fruit knife, dinner knife, art knife, bistouries, scissor, and steel file, iron awl, axe, short stick, and hammer etc., shall be carried as checked baggage.

8.1.3.6 Pet or guide-dog as specified in 8.7.

8.1.3.7 The folding wheelchair or electric wheelchair used by passengers in travel.

8.1.3.8 Liquid hand-carried by passenger.

8.1.3.9 Items not suitable to be carried in cargo compartment such as delicate musical instrument and not meeting the requirements of weight and size by 8.4, shall be carried in passenger cabin as seat-taking baggage. Extra fees shall be charged for such items, and such items shall be taken care of by the passenger.

8.1.4 Right to refuse carriage

In the exercise of JC AIRLINES's discretion, JC AIRLINES may refuse to carry passenger or his/her baggage after informing the passenger. In this circumstance passenger will be entitled to a refund. JC AIRLINES may also refuse to carry passenger or his/her baggage for any of the following reasons:

8.1.4.1 JC AIRLINES has the right to refuse to accept or suspend the carriage of the baggage if it belongs to or contains the items listed in 8.1.1 or the items listed in 8.1.2 carried in the checked baggage.

8.1.4.2 Unless advance arrangements for its carriage have been made with JC AIRLINES, JC AIRLINES may carry on later flight baggage that is in excess of the applicable free allowance.

8.1.4.3 JC AIRLINES may refuse to accept baggage as checked baggage unless it is properly packed or its contents comply with the carriage requirements.

8.1.4.4 The carriage of passenger or his/her baggage violates any applicable laws, regulations, or orders of any State to be flown from, to or over.

8.1.4.5The carriage of passenger or his/her baggage may endanger or affect the safety, health, convenience, comfort of other passengers or crew members.

8.2 Checked baggage

8.2.1 Checked baggage must meet the following requirements:

8.2.1.1 Passenger must check baggage with a valid ticket. JC AIRLINES shall correctly enter the pieces and weight of checked baggage into departure system. Each passenger's baggage must be recorded on his own record. If passenger holds a paper ticket, baggage content shall be written on the correspondent spot of ticket.

8.2.1.2 JC AIRLINES generally collects baggage at the time of check-in on the day of departure. If the passenger requests to check in advance, it can be agreed in advance.

8.2.1.3 JC AIRLINES shall attach a baggage tag to each piece of passenger's checked baggage, and give a baggage identification tag to passenger.The hand-carry baggage approved by JC AIRLINES, is carried into the cabin and taken care of by the passengers after being weighted together with the checked baggage, filled in the ticket separately and attached a hand-carry baggage tag.

8.2.1.4 The weight and size of checked baggage shall not exceed  JC AIRLINES's restrictions; those checked baggage exceeding such restrictions shall be carried as cargo.

8.2.1.5Passenger shall attach name or other personal mark to the checked baggage before checking it in.

8.2.1.6 Checked baggage must be well packed, locked and bound, and must be able endure a certain amount of pressure, and can be safely loaded, unloaded and carried under normal operation conditions, and shall meet the following requirements:

1)Suitcase and handbags and so on must be locked;

2)It's not allowed to bound more than two pieces of baggage into one piece;

3)It's not allowed to attach other items to baggage;

4)Bamboo baskets, net bags, grass strings, grass bags and so on are not allowed to be used as packing materials;

5)Passenger's name, detailed address and telephone number shall be written on baggage.

8.2.1.7 Checked baggage will, whenever possible, be carried on the same aircraft with passenger, unless otherwise carried on other flights for safety, security or operational reasons. If passenger's checked baggage is carried on a subsequent flight, carrier will deliver it to passenger, unless applicable law requires passenger to be present for customs clearance.

8.3 Free baggage allowance

8.3.1 The free checked-baggage allowance per passenger is calculated based on the class:

8.3.1.1 Free checked-baggage allowance

1) 40 kg for First Class passengers with adult or child tickets, 30 kg for Business Class passengers and 20 kg for Premium Economy Class and Economy Class passengers.

2) Passengers with infant tickets are given a free baggage allowance of 10 kg and allowed to carry a folding stroller or a cradle for free.

3) Each passenger can only carry one piece of hand-carry baggage with a weight of no more than 10 kg, a volume of no more than 20 x 40 x 55 cm, and can be placed in an enclosed baggage rack.

8.3.1.2   Free baggage allowance for piece counting

From or to Canada or the United States, the free baggage allowance for piece counting is specified as below:

1) For passengers with adult or child tickets, the free baggage allowance for First Class or Business Class is two pieces of baggage. The sum of the three dimensions of each piece must not exceed 158 cm (62 inches) and the maximum weight should not exceed 32 kg (70 lbs). The free baggage allowance for Premium Economy Class and Economy Class is two pieces of baggage. The sum of the three dimensions of each piece must not exceed 158 cm (62 inches) and the maximum weight should not exceed 23 kg (50 lbs).

2) Infants with infant tickets can only have one free checked baggage and a folding stroller or carriage. The sum of the three dimensions of the checked baggage shall not exceed 115 cm.

From or to Europe (excluding the Russian and Central Asian routes operated by JC AIRLINES), the free baggage allowance for piece counting is specified as below:

1) For passengers with adult or child tickets, the free baggage allowance for Business Class is three, the free baggage allowance for Premium Economy Class is two, and the free baggage allowance for Economy Class is one. The sum of the three dimensions of each piece of baggage shall not exceed 158 cm (62 inches) and the maximum weight shall not exceed 23 kg (50 lbs).

2) Infants with infant tickets can only have one free checked baggage weighing no more than 10 kg and a folding stroller or carriage. The sum of the three dimensions of the checked baggage shall not exceed 115 cm.

8.3.1.3 As for the passenger who buys mixed class ticket, the free baggage allowance shall be counted as per the rules for each class of the flight.

8.3.1.4 For more than two (included) passengers who take the same flight to the same destination, if they proceed with the baggage check formality at the same time and same location, their free baggage allowances may be calculated as one integrity in accordance with their respective cabin-class standards which they have purchased.

8.3.1.5  As for the domestic leg of the international flight, the applicable free-baggage allowance for the passengers shall be handled as per the regulations for the international flight.

8.3.1.6 If the passenger is voluntarily to change his/her class level, he/she should enjoy a free baggage allowance that corresponding to his/her new ticket; If the passenger is unwilling to change the class level, he/she should enjoy the corresponding free-baggage allowance to his/her original level of ticket.

8.3.1.7 The maximum weight of a single piece of baggage on any international route shall not exceed 32 kg.

8.4 Free hand-carry baggage

8.4.1 Weight and size

Each passenger who is entitled to travel in First Class can bring two pieces of hand-carry baggage, each of which must not exceed 5kg in weight. Each passenger who is entitled to travel in Business or Economy class can bring one piece of hand-carry baggage, each of which must not exceed 5kg in weight. The sum of the three dimensions of each piece must not exceed 115cm. Such baggage can be placed in the baggage cabin or under the seat in the passenger cabin.

8.4.2 Bulky baggage

Objects not suitable for carriage in the cargo compartment (such as delicate musical instrument) and not complying with provisions in 8.4.1  will only be accepted for carriage in the passenger cabin as seat-taking baggage and be taken care of by passenger, if due notice has been given in advance and permission granted by JC AIRLINES. The carriag of such objects may be charged separately.

8.4.3 Checked baggage and un-checked baggage shall be weighed or piece-calculated together at the time of check-in. Checked baggage is under custody of JC AIRLINES during the travel, while the unchecked baggage shall be taken care of by passenger in the travel.

8.5 Excess baggage

8.5.1 Excessive baggage means the part of baggage in excess of the free baggage allowance of weight or in pieces.

8.5.2  Passengers should pay excess baggage fees for their excessive baggage, and the carrier and authorized agent will fill the excessive baggage receipt. Excessive baggage charging rate and calculation method shall be handled in accordance with JC AIRLINES regulations.

8.6 Declaration and charge

8.6.1  General provisions

8.6.1.1 A passenger may declare a value for checked baggage in excess of USD30 or its equivalent per kilogram, and shall pay an applicable charge.

8.6.1.2 No declaration value for pet will be accepted.

8.6.1.3 JC AIRLINES will charge an fee of 5‰ of extra declared value exceeding the limitation of 8.6.1.1.

8.6.2 JC AIRLINES may refuse to offer an excess value declaration service on checked baggage when a portion of the carriage is to be provided by another carrier who does not offer such service.

8.6.3 The declaration for checked baggage must not exceed the real value of the baggage. The maximum declared value of each passenger is USD5,000 or its equivalent value in other currencies. If JC AIRLINES disagrees with a value declaration and the passenger refuses to be checked, JC AIRLINES has the right to refuse carriage.

8.7 Pets and guide dogs

8.7.1 Pets mean such little animals as domestic dogs, cats, birds and other household pets. Animals with too small shape (such as: rodents, ornamental fish, etc.) or too large shape (cage packaging exceeds the maximum volume limit) or may be harmful to transport safety or any wild and aggressive animal such as snakes will not be accepted for transportation. The carrier has the right to determine whether an animal can be carried and the way of carriage, and has the right to restrict the number of pets on a plane.

8.7.2 Pet may be accepted for carriage subject to following rules:

8.7.2.1 Have valid certificates necessary for entry, exit and transit permits required by Kingdom of Cambodia and countries involved in transportation;

8.7.2.2  With the advance agreement of JC AIRLINES and other carriers concerned, and formalities required by JC AIRLINES and other carriers concerned.

8.7.3Guide dog means special dogs that assist in the life and work of disabled people, including assistant dogs, listening ear dogs, andseeing eye dogs.

8.7.4  The carriage of guide dogs shall be dealt in accordance with 8.7.2. Guide dogs, if they meet the requirements of the JC AIRLINES, may accompany the disabled eligible to travel in passenger cabin. The disabled eligible to travel shall provide the identity and quarantine proofs for guide dogs. Guide dogs, together with its cage and food can be carried for free, without taking up the free baggage allowance.

8.7.5  Acceptance for carriage of animals (include guide dogs) is subject to the conditions that the passenger assumes full responsibility for injury to or loss, delay, sickness or death of such animal unless due to JC AIRLINES's faults. JC AIRLINES shall not be liable for injury to or loss, delay, sickness or death of such animal in the event that it is refused entry into or passage through any country, state or territory.

8.7.6 The passenger is fully liable for all damages or injuries which a pet might cause to other passengers or crew members.

8.7.7 Carriers will have no liability in respect of any such animal not having all the necessary exit, entry, health and other documents with respect to the animal's entry into or passage through any country or region.

8.7.8  JC AIRLINES may refuse to accept the carriage of pet and guide dog on non-stop long-haul flight or some specific type of aircraft due to the unsuitability.

8.8 Delivery of baggage

8.8.1 Passengers should collect baggage with the baggage tag at places of destination or stopover indicated on the “ticket and baggage ticket”.

8.8.2  With JC AIRLINES's consent, passenger can collect his baggage at stopover, the unused payment of the excess baggage will not be refunded.

8.8.3  If the passenger does not collect his baggage in time, JC AIRLINES will charge the passenger baggage keeping fee from the next day after the arrival of the baggage. JC AIRLINES has the right to deal with the perishable items in passenger's baggage 24 hours after the arrival of the baggage.

8.8.4 JC AIRLINES is under no obligation to ascertain that the bearer of the baggage identification tag is entitled to delivery of the baggage and JC AIRLINES is not liable for any loss or expense arising out of or in connection with such delivery.

8.8.5 If a person claiming the baggage is unable to identify the baggage by the baggage identification tag, JC AIRLINES will deliver the baggage to such person only on condition that he or she provides proofs recognized by JC AIRLINES. And if required by JC AIRLINES, such person shallfill out a declaration to indemnify JC AIRLINES for any loss which may be incurred by JC AIRLINES as a result of such delivery.

8.8.6  Acceptance of baggage by the bearer of the baggage check, without complaint in written form at the time of delivery, is prima facie evidence that the baggage has been delivered in good condition and in accordance with the contract of carriage.

8.9 Un-delivered baggage

If baggage is not collected after 90 days from the next day of baggage's arrival, JC AIRLINES has the right to process it according to the regulations on un-delivered baggage.

8.10 Processing of abnormal carriage of baggage

8.10.1 In the event of delay, loss or damage in the carriage of baggage, JC AIRLINES and JC AIRLINES's authorized ground handling agency, together with passenger, shall fill up a Record Form of Accidents of Baggage Carriage, check out the situation and reasons, and report the results of investigation to passenger and departments concerned. If compensation for baggage happens, it can be processed at the travel's origin, stopover or destination.

8.10.2 If the checked baggage fails to arrive in the same flight with the passenger due to JC AIRLINES reasons and thereby cause inconvenience for passenger’s life, JC AIRLINES shall give appropriate compensation for passenger’s temporary life use.

8.11 Compensation for baggage

8.11.1 Compensation limit

8.11.1.1  The Montreal Convention stipulates that for the destruction, loss, damage or delay of baggage in the international baggage carriage, the liability limit for each passenger is 1131 Special Drawing Rights. This Convention entered into force in Kingdom of Cambodia on July 31, 2005, and the revised limit of liability entered into force for all parties to the Convention from December 30, 2009.

8.11.1.2 If the weight of the baggage is not recorded on the baggage check, the total weight of the baggage with compensation shall not exceed the applicable free baggage allowance for the class of service concerned

8.11.1.3 According to the above provisions, the checked baggage which has made an declaration should made compensation as per the declared value. If the declared value is beyond the actual value of the baggage, the compensation should be made as per the actual value.

8.11.2 Time limitation on claims and litigation

8.11.2.1 Time limitation on claims

1)  No action shall lie in the case of damage to checked baggage unless the person entitled to delivery complains to JC AIRLINES forthwith after the discovery of the damage, and, at the latest, within seven working days from the date of receipt; and in the case of delay, unless the complaint is made at the latest within twenty-one working days from the date on which the baggage has been placed at his or her disposal.

2) Any claims shall be raised in written form within time limit, or no compensation shall be raised towards JC AIRLINES.

8.11.2.2  Any right to damages shall be extinguished if an action is not brought within two years reckoned from the date of arrival at the destination or from the date on which the aircraft ought to have arrived, or from the date on which the carriage stopped.

 

Chapter 9 Schedules, Changes and Cancellations of Flights

9.1  Schedules

9.1.1 JC AIRLINES undertakes to use its best efforts to carry the passenger and his or her baggage with reasonable dispatch and to adhere to published schedules in effect on the date of travel.

9.1.2  JC AIRLINES will take all reasonable measures to avoid delays in passengers and baggage. JC AIRLINES will not be liable if JC AIRLINES has taken all reasonable measures or it is unlikely to take such measures.

9.1.3  The flight times and aircraft types shown in timetables may change between the date of publication and the date passenger actually travel. JC AIRLINES does not guarantee them to passengers, and the flight times and aircraft types do not form part of contract with JC AIRLINES.

9.1.4 Before JC AIRLINES accept passengers reservation for a flight, JC AIRLINE will notify the passenger of the scheduled flight time in effect as of that time, and it will be shown on ticket. It is possible JC AIRLINES may need to change the scheduled flight time subsequent to the issuance of the ticket. If passenger provides JC AIRLINE with contact information, JC AIRLINES will endeavor to notify the passenger of any such changes. If, after ticketing, JC AIRLINES makes a significant change to the schedule flight time, which is not acceptable to the passenger, and JC AIRLINE is unable to book the passenger on an alternate flight which is acceptable to passenger, passenger will be entitled to a refund in accordance with the regulation of involuntary refund.

9.2 Cancellation, Changes of Flights

For the following reasons, schedules are subject to cancel, terminate, change, or delay without notice:

9.2.1 For complying with any government law, regulation, or order;

9.2.2  For security of flight;

9.2.3 Due to circumstances beyond its control or unable foreseen.

9.3 Due to one of the reasons in 9.2, JC AIRLINES cancels or delays the flight and is unable to provide the passenger with the seat reserved (including the class), or fails to stay at the stopover point or destination of the passenger, or causes the misconnection with passenger’s other flights with reservation, JC AIRLINES shall take into account the reasonable needs of passengers and take one of the following measures:

9.3.1 Arrange passenger to travel on the soonest flight of JC AIRLINES with available seats.

9.3.2 Make endorsement after agreed by passengers and carriers concerned.

9.3.3 To refund according to rules of involuntary refund.

9.4 The remedies listed in 9.3 are all remedies available to passengers. JC AIRLINES no longer assumes other responsibilities except as otherwise provided by the Convention.

9.5 JC AIRLINES will take all necessary measures to avoid delays in passenger and passenger baggage. JC AIRLINES is not liable if JC AIRLINES has taken all necessary measures or it is unlikely to take such measures.

Chapter 10 Ticket change

10.1 Involuntary Change

10.1.1 If such unpredictable non-JC AIRLINES reasons as weather, air traffic control cause JC AIRLINES flights, cancellation, advancement, delay, change, mis-connection, or failure to provide reserved seats, JC AIRLINES shall consider passengers’ reasonable requests and take one of the following measures:

10.1.1.1 Arrange on priority available seats on JC AIRLINES flights for passengers;

10.1.1.2  Make endorsement after agreed by passengers and carriers concerned.

10.1.2 If such JC AIRLINES reasons as aircraft maintenance, flight readjustment cause JC AIRLINES flights cancellation, advancement, delay, change, mis-connection, or failure to provide reserved seats, JC AIRLINES shall consider passengers’ reasonable requests and take one of the following measures:

10.1.2.1   Arrange on priority available seats on JC AIRLINES flights for passengers;

10.1.2.2 Make endorsement after agreed by passengers and carriers concerned.

10.1.2.3 Change the route listed on original ticket, and arrange passengers to arrive at destination or stopover point via JC AIRLINES or other carriers’ flights, or via other means of transportation mutually agreed. Overpaid amount of ticket fare, excessive baggage fee and other service charges will be returned, while deficiency of such fares and charges will be ignored.

10.2  Voluntary change of class (including original class and actual class)

After purchasing the ticket, if the passenger requires to change the class, JC AIRLINES and JC AIRLINES authorized sales agents shall actively handle the it with the available seats and time permit. If the change of the class causes the fare change: if the fare is increased, the difference shall be paid by the passenger, and the change fee and the no-show charge shall be charged; if the fare is reduced, the ticket shall be refunded according to the rules of voluntary refund.

10.3   Voluntary change of flight and date

After purchasing the ticket, if the passenger requires to change the flight and date, it shall be handled in accordance with JC AIRLINES's published conditions for the tariff use and the relevant provisions for speacial fares.

10.4 Endorsement

10.4.1 In the event of involuntary change of carrier for passenger, endorsement formalities shall be done after agreed by passenger and carrier concerned.

10.4.2 In the event of voluntary change of carrier requested by passenger, JC AIRLINES can make endorsement when all the following requirements are met:

10.4.2.1 Passenger's applicable fare does not have endorsement restrictions.

10.4.2.2 The carrier to be changed into must have has signed an interline agreement, and can issue or receive tickets mutually with JC AIRLINES.

10.4.3 When passenger does not meet all the requirements in10.4.2 and demands change of carrier, it shall be processed according to rules of voluntary refund.

10.4.4 Unless specially authorized by JC AIRLINES, JC AIRLINES's sales agencies are not allowed to do endorsement formalities for passenger.

 

Chapter 11 Refund

11.1 General provisions

11.1.1 On failure by JC AIRLINES to provide carriage in accordance with the contract of carriage, or where a passenger requests a voluntary change of his or her arrangements, refund for an unused ticket or portion thereof shall be made by JC AIRLINES according to regulations.

11.1.2 Except in the case of lost tickets, refunds will only be made on surrender of all unused flight coupons and passenger coupons, proof of payment and complete conjunction tickets if any. For electronic tickets, refund must be applied not later than 13 months after the date of commencement of travel (or the date of issuance for all first flight coupon unused ticket). Application for refund will only be accepted when the coupon's status is OPEN FOR USE, and with payment proof provided by passenger.

11.2 Person receiving refunded fares

11.2.1 JC AIRLINES shall be entitled to make refund to the person named in the ticket.

11.2.2 If a ticket has been paid for by a person other than the passenger named in the ticket, and JC AIRLINES has indicated on the ticket that there is a restriction on refund, the refund will be made only to the person paying for the ticket or to that person’s order.

11.2.3 Passenger or payer who requests the refund shall present his or her valid identity certificate. If the person requesting refund is not the passenger or the payer, he or she must present the identity certificate of himself or herself and the authorization and valid identity certificate of the passenger or payer in addition.

11.2.4 A refund made pertain to 11.1 to anyone whom refund may be made in terms of 11.2.1, 11.2.2, 11.2.3 shall be deemed a proper refund and shall discharge JC AIRLINES from liability.

11.2.5 When refunding an electronic ticket, passenger is required to provide printed itinerary.

11.3 Time limit for refund

Refund must be applied not later than 13 months after the date of commencement of travel (or the date of issuance for all first flight coupon unused ticket). Application for refund will not be accepted after the time limit.

11.4 Place of refund

11.4.1On principle, refund of tickets (including MCO) shall be processed in the original place of payment; exchanged tickets can also be refunded in the place of exchange. In the event of involuntary refund, refund can be processed in JC AIRLINES's sales office in the place of original purchase, commencement of travel, stopover, or destination of travel, or in JC AIRLINES's authorized sales agencies in the place where the cause of involuntary refund happens.

11.4.2 When passenger applies for refund in a place other than the original place of issuance, the JC AIRLINES's sales office which is to process refund shall obtain authorization from the original place of issuance, and refund in the local currency at that day’s BBR according to the refunded amount provided by original place of issuance.

11.4.3 When passenger holding an open-date ticket applies for refund, refund must be processed in the original place of issuance.

11.5 Currency

All refunds will be subject to laws, rules and regulations of the country in which the ticket was originally purchased and of the country in which the refund is being made. Refunds will normally be made in the currency in which the ticket was paid for, or in another currency in accordance with JC AIRLINES's regulations.

11.6 Involuntary refunds

Involuntary refund means any refund applied for by passenger entitled to travel on JC AIRLINES's flights who cannot be carried according to carriage contract due to such uncontrollable or unpredictable reasons as weather, air traffic control, aircraft maintenance, flight readjustment.

In the event of involuntary refund, refund can be processed in JC AIRLINES's sales office in the place of original purchase, commencement of travel, stopover, or destination of travel, or in JC AIRLINES's authorized sales agencies in the place where the cause of involuntary refund happens.

11.6.1 Involuntary refund abides by the following rules:

11.6.1.1 If no portion of the ticket has been used, an amount equal to the fare paid including taxes and charges will be refunded, without charging refund fee.

11.6.1.2 If a portion of the ticket has been used, subtract the amount of individual or group fare on the used sectors and subtract the amount of used taxes and charges. The refunded amount shall not be higher than the amount paid. No refund fee shall be charged.

11.6.1.3 If the flight lands at an airport other than the appointed stopover and flight of the same day is cancelled, and if the passenger demands for refund, fare from the landed airport to the destination at the same discount rate or sub-class with the original paid fare shall be refunded, but the refunded amount shall not be higher than the paid amount; no refund fee shall be charged. Applicable carrier fare from landed airport to destination shall be chosen on priority. If there are no published fares from landed airport to destination, fare of other means of transportation from landed airport to destination shall be refunded. Where there are more than one applicable fare of a same means of transportation, the medium one shall be chosen.

11.6.1.4 Change fee shall be paid by passenger who requires flight change of his/her own will. When the changed flight is not performed as scheduled, the ticket can be refunded without refund fee while the previously paid change fee shall not be refunded.

11.7 Voluntary refund

Refund beyond the limitations in 11.6 belongs to voluntary refund.

11.7.1 Voluntary refund abides by the following rules:

11.7.1.1 If no portion of the ticket has been used, an amount equal to the fare paid, less any refund fees.

11.7.1.2 If a portion of the ticket has been used, the refund will be an amount equal to the difference between the fare paid and the applicable fare for travel between the points for which the ticket has been used, and subtract refund fees and no-show fees if any.

11.7.1.3 Special regulations will be applied to the ticket with a special fare paid.

11.8 Refund to credit card or debit card accounts

Refund for tickets paid with credit cards or debit cards can only be credited to the card account originally used for the ticket purchase. The refundable amount to be paid by JC AIRLINES will be in accordance with the rules within this article only, on the basis of the amount originally paid by passenger and the currency entered in the ticket. If there's any difference of amount caused by currency exchange, passenger is not entitled to claim damages to JC AIRLINES.

11.9 When refunding a ticket priced according to the tariff combination rule, the relevant provisions on the refund shall be executed in accordance with the most stringent rules of use.

11.10 Refusal of refund: Except for involuntary refund, departments concerned shall refuse to refund in any one or more of the following situations:

11.10.1 Refund is applied for after the time limit of refund;

11.10.2 Passenger fails to present valid certificates or tickets on applying for refund;

11.10.3 When the applicable fare of used sectors is equal to or higher than that of the whole travel, the unused sectors cannot be refunded;

11.10.4 Ticket is annotated non-refundable.

11.11 Tax refunding: On refunding, passenger's paid but unused taxes shall be refunded together. Taxes of ticket which is non-refundable or has no applicable remaining amount for refund can also be refunded alone without extra charge, but must be refunded before the time limit of refund.

11.12 Refund due to passenger’s illness shall be processed as voluntary refund.

11.13 Unless otherwise specified, children shall be charged the same refund fee as adults, and infants are exempt from refund fee.

 

Chapter 12 Conduct aboard Aircraft

12.1If passenger conducts himself or herself aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstructs the crew in the performance of their duties, or fails to comply with any instruction of the crew, or behaves in a manner to which other passengers may reasonably object, JC AIRLINES may take such measures as it deems necessary to prevent continuation of such conduct, including restraint of the passenger. Passenger may be disembarked and refused onward carriage at any point and passenger may be prosecuted for offences committed on board the aircraft.

12.2Passenger may not use mobile phone, interphone, radio controlled toys and other remote control electronic device and other radio transmitting devices that JC AIRLINES and relevant departments believe they may interfere with aircraft flight safety. The passenger shall not operate any other electronic devices on board without JC AIRLINES's permission, except that hearing aids and heart pacemakers may be used.

12.3 Non-smoking flights

All JC AIRLINES flights are non-smoking flights. Smoking is prohibited in all areas of the aircraft.

12.4 Restriction on alcoholic drinks

While aboard aircraft, passenger is not allowed to drink any alcoholic drinks other than those provided by JC AIRLINES.

12.5 Seat belts

While in seat on board the aircraft, passenger shall fasten his or her seat belt as required.

 

Chapter 13 Refusal and Limitation of Carriage

13.1  JC AIRLINES may refuse carriage of any passenger or passenger's baggage in one of the following circumstances, for reasons of safety or if, in the exercise of its reasonable discretion:

13.1.1 The carriage is prohibited by any applicable laws, regulations, or orders of the State;

13.1.2 Passenger does not abide by the laws, regulations, or orders of the State, or does not abide by JC AIRLINES's regulations.

13.1.3 Passenger refuses to submit to security check conducted by government, airport or JC AIRLINES.

13.1.4 Passenger fails to be properly documented according to concerned laws, regulations, orders, requests, or requirements of travel conditions.

13.1.5 Passenger refuses to comply with instructions issued by the crew member or authorized company staff and to execute the company's instructions on export seat restrictions.

13.1.6 Passenger refuses to comply with the crew instructions.

13.1.7 Due to physical disability, the only seat suitable for passenger with disability is the exit seat;

13.1.8 Actions must be taken because of weather or other reasons beyond the control of JC AIRLINES;

13.1.9 Passenger fails to pay applicable fare, fee and taxor fails to accept the credit payment with JC AIRLINES or the relevant carrier

13.1.10 The ticket presented by the passenger has been acquired unlawfully or has been purchased from an entity other than the issuing carrier or its authorized sales agent, or has been reported as being lost or stolen, or is counterfeited or any flight coupon has been changed by anyone other than JC AIRLINES or its authorized sales agent, or the coupon is altered.

13.1.11 The person presenting the ticket cannot prove that he or she is the person named in the ticket.

13.1.12 Passenger is over 9 months (36 weeks) pregnant.

13.1.13 Passenger is less than 14 days old.

13.1.14 The conduct, age, or mental or physical state of the passenger is such as to unsuitable for air travel, or cause discomfort or make himself or herself objectionable to other passengers or involve any hazard or risk to himself or herself or to other persons or to property.

13.1.15 Passenger has been diagnosed with serious infectious disease, and fails to present any medical proof that necessary measure have been taken to prevent infecting others.

13.1.16 JC AIRLINES determines that passenger may be unable to comprehend or operate safety instructions under their physical or mental conditions without assistance from flight attendants.

13.1.17 Passengers conduct may endanger themselves, cabin crew or other passengers due to mental disability.

13.1.18 Passenger has traces of being drunk or having drug abuse.

13.1.19 Passenger is or appears to be intoxicated.

13.1.20 Passenger requires intravenous injection.

13.1.21 Passenger has odors that are not caused by disability or disease;

13.1.22 Dressing of passenger may cause discomfort to other passengers;

13.1.23 Stretcher passenger does not meet the safety requirements of passenger carriage.

13.1.24 Passenger may seek immigration in transit country, or may destroy their certificates or documents during flight, or passenger fails to submit their travel documents or their copies to cabin crew according to requirements of JC AIRLINES.

13.1.25 Passenger's conduct, on purpose or not, may endanger the safety of aircraft or passengers on board.

13.2 Arrangement for passengers whose carriage has been refused

In the JC AIRLINES operation, when the refusal to passenger carriage occurs, the carriage service department will do the necessary post-processing for the passengers who are refused to carriage according to the relevant provisions of JC AIRLINES's Ground Service Guarantee Manual.

13.3 Limitation on carriage

Unless otherwise stipulated by government documents or documents of sports meeting for the disabled, unaccompanied children over the age of five but under the age of twelve, ill passengers, pregnant women, blind, deaf or crime suspects can only be carried when JC AIRLINES's concerned regulations are met, and when it has been agreed by JC AIRLINES and JC AIRLINES has made arrangements when necessary.

 

Chapter 14 Additional service arrangements

14.1 If JC AIRLINES arranges for passengers to provide services other than air transportation provided by third parties, or JC AIRLINES issues tickets or receipts for (non-aviation) transportation or services provided by third parties such as ground transportation, hotel reservations or vehicle rentals, JC AIRLINES only acts as an agent for passengers when arranging the above additional services. Passengers are not liable for the quality of such services and such services. The terms and conditions of the third party service provider apply to the service.

14.2 If JC AIRLINES also provides ground transportation to passengers, this condition does not apply to the ground transportation.

 

Chapter 15 Administrative Formalities

15.1 General provisions

15.1.1The passenger shall be solely responsible for obtaining necessary documents and visas of countries to be flown from, into or over complying with all laws, regulations, orders, demands and travel requirements.

15.1.2 JC AIRLINES shall not be liable for the consequences to any passenger resulting from his or her failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions.

15.2 Travel documents

The passenger shall present all exits, entry, health and other documents required by laws, regulations, orders, demands or requirements of the countries concerned, and permit JC AIRLINES to take and retain copies thereof. JC AIRLINES reserves the right to refuse carriage of any passenger who has not complied with requirements above or whose documents do not meet requirements.

15.3    Refusal of entry

The passenger shall pay any fines or fees imposed by the relevant government on JC AIRLINES and carriage fare to his or her point of origin, owing to the passengers inadmissibility into a country. The fare collected for carriage to the point of refusal of entry will not be refunded by JC AIRLINES.

15.4    Passengers are responsible for paying fines,detention fees, etc. JC AIRLINES is not liable for any loss or damage arising from such inspections, or for any loss or damage resulting from the passenger's failure to comply with such requirements. If the passenger fails to comply with the laws, regulations, orders, requirements or other travel regulations of the relevant country, or the passenger fails to produce the required documents, JC AIRLINES is therefore required to pay the fine or bear any expenses, the passenger shall reimburse JC AIRLINES for any payment or any expenses incurred. JC AIRLINES may deduct the above fees from the fare of the passenger's unused flight segment or the amount JC AIRLINES is in charge of. In order to avoid the loss of passengers, passengers shall know in detail before the travel and comply with the relevant regulations of any country to be flown from, to or over.

15.5 Customs inspection

If required, the passenger shall attend inspection of his or her baggage by customs or other government officials.

15.6 Security check

The passenger shall submit to any security checks required by government, airport officials, other carriers or JC AIRLINES. JC AIRLINES is not liable to passenger for any bodily injury, loss of or damage to the passenger caused by such check, unless such injury, damage or loss is caused by the fault of JC AIRLINES.

 

Chapter 16 Passenger Services

16.1 Unless otherwise specified, in-flight meals shall be provided by JC AIRLINES free of charge. JC AIRLINES may charge a fee if the passenger requests more than the other services specified.

16.2 Except as otherwise specified, JC AIRLINES does not provide ground transfer service within airport areas or between airports or between airports and downtown. JC AIRLINES is not liable for liable for the acts of the provider of such ground transfer services or anything done by an agent or representative of JC AIRLINES in assisting the passenger to make arrangements for such transfer service.

16.3 Passenger shall pay for expenses of hotel accommodation at the connection point.

16.4 If illness happens to passenger during air carriage, JC AIRLINES shall take active measures and do its best to save the passenger.

16.5 Services for abnormal flights

16.5.1 If fights are delayed or cancelled at origin due to such reasons as aircraft maintenance, flight readjustment, or flight crew, JC AIRLINES shall provide meals or accommodations to passengers according to regulations concerned.

16.5.2 If flights are delayed or cancelled at origin due to non-JC AIRLINES reasons including but not limited to weather, accidents, air traffic control, airport, or passengers, JC AIRLINES shall assist passengers arrange meals or accommodations on passengers’ own expenses.

16.5.3 If flights are delayed or cancelled at transit point due to any reason, JC AIRLINES shall provide accommodations to transit passengers.

16.5.4 When flights are delayed or cancelled, JC AIRLINES and JC AIRLINES's ground service agencies shall explain and inform passenger promptly about the latest information of flights’ delay or cancellation.

 

Chapter 17 Liability for Damage

17.1 JC AIRLINES's carriage responsibility for passenger is subject to the carriage conditions, and the carriage responsibility of other carriers concerned is subject to their carriage conditions respectively.

17.2 During carriage, JC AIRLINES only is liable for damage occurring on flights carried by JC AIRLINES. When JC AIRLINES issues ticket or carries out baggage check for other carriers' flights (including codeshare flights), it acts only as an agent of the other carrier and fulfills the obligation to inform the passenger of the actual carrier. For flights that are not actually carried by JC Airlines (including codeshare flights), in the event of flight change, delay, cancellation, overbooking, baggage damage or loss, personal injury, etc., the actual carrier shall bear the corresponding liability, and JC AIRLINES shall assist the passenger to contact the actual carrier.

17.3 JC AIRLINES is not liable for any loss arising from its compliance with any laws or Government regulations or requirements, or from failure of the passenger to comply with the same.

17.4 Unless otherwise specified, according to the applicable provisions of the Convention, JC AIRLINES's liability shall not exceed the amount of proven loss and damages.

17.5 If the damage is caused or contributed by passenger fault, it shall exempt or reduce JC AIRLINES's liability according to the applicable laws.

17.6 JC AIRLINES carriage contract includes the Conditions and articles exempting or limiting liability, and is also applicable to JC AIRLINES's authorized agents and employees. In any case, the sum of compensation from JC AIRLINES, JC AIRLINES's authorized agents and employees may not exceed the liability limit of JC AIRLINES.

17.7 Unless clearly specified, the Conditions will not render JC AIRLINES to give up the provisions of the Convention or applicable laws on exemption or limitation of JC AIRLINES liability.

17.8 JC AIRLINES is not liable for any illness, injury or disability, including death, if the passenger's physical condition is attributable to such condition.

17.9 JC AIRLINES is not liable for damage caused by passenger’s baggage or property contained in such passenger's baggage. Passenger shall be liable for that his/her property causes injury to another person or damage to another person's property or to the property of JC AIRLINES.

17.10 For item carried in checked baggage, which is prohibited by JC AIRLINES, JC AIRLINES shall not be liable for its damage.

17.11 International carriage as defined by the Convention shall apply the rules of liability of the Convention. For international carriage as not defined by the Convention, JC AIRLINES shall be liable for damages in accordance with the relevant provisions of the Montreal Convention for any damage to passengers and baggage caused by carriage.

17.12 Liability

17.12.1 The application of the limit of liability compensation

17.12.1.1 If it is subject to the “International Transportation" stipulated in The Montreal Convention of 1999, the liability limit compensation provision in this Convention shall be applied in priority.

17.12.1.2   If it is subject to the “International Transportation" stipulated in Warsaw Convention of 1929 and The Hague Protocol of 1955 but not subject to those in The Montreal Convention, the liability limit compensation provision in The Warsaw Convention and The Hague Protocol shall be applied in priority.

17.12.1.3 If the compensation is not subject to the “International Transportation" in Conventions, then the bilateral treaty or associated domestic law, such as Civil Aviation Law of Kingdom of Cambodia, government regulations and orders shall be applied to.

17.12.2 The regulations from the Conventions on the limit of liability compensation

17.12.2.1  Warsaw Convention and The Hague Protocol

1) The amount of the liability compensation for casualty of passenger shall not exceed 250,000 gold francs or equivalent price.

2) The amount of the liability compensation for checked baggage shall not exceed 250 gold francs or equivalent price; the amount of the liability compensation for unchecked baggage and hand-carry baggage shall not exceed 5,000 gold francs or equivalent price per passenger. If there is no baggage weight record on the baggage ticket, the total weight of the checked baggage is considered not to exceed the free baggage allowance applicable to the seat class, and the liability compensation is limited to the stated value.

17.12.2.2  The Montreal Convention of 1999

1) For those casualty compensations that not exceed 100,000 special drawing rights per passenger are applicable for Article 20 and the Item 1 of Article 21 of the Convention.

2)  For those casualty compensations that exceed 100,000 special drawing rights per passenger are applicable for Article 20 and the Item 2 of Article 21 of the Convention.

3) The limit of liability compensation of JC AIRLINES for baggage (including checked baggage, unchecked baggage and free carry-on articles) shall not exceed 1131 Special Drawing Rights or equivalent price per passenger. For the checked baggage for which the declared value is handled in accordance with Article 6 of Chapter 8 of these Conditions, the liability compensation is limited to the stated value.

 

Chapter 18 Other Provisions

18.1 For the carriage of passengers and baggage, the passengers shall also comply with other applicable regulations and conditions of JC AIRLINES. These regulations may vary and are very important, including carriage regulations for unaccompanied children, pregnant women and sick passengers, restrictions on the use of electronic devices, and regulations for drinking alcohol on board aircraft. The above relevant carriage regulations and conditions can be inquired from JC AIRLINES.

18.2 The carriage on the route between China, Hong Kong Special Administrative Region and Macao Special Administrative Region shall be carried out in accordance with these Conditions.

18.3 Short headings under each clause of these Conditions are for convenience only and are not intended to be used to interpret the terms.

18.4 These Terms are written in both Chinese and English, both texts being equally authentic.

 

Chapter 19 Effectiveness and Modification

19.1 The Conditions come into effect and is implemented on the date of publication.

19.2 JC AIRLINES may modify these Conditions without notice according to the routing procedure of CAAC. This modification will not apply to the carriage that starts before of such modification.

19.3 No agent, employee or representative of  JC AIRLINES has authority to alter, modify or waive any provision of the Conditions.

19.4 JC AIRLINES reserves the right of interpretation of the Conditions.
